Terms & Conditions

(1) Introduction

Please read these terms of sale carefully.

By purchasing products from this website, you will be agreeing to these terms and conditions of sale.

(2) Interpretation

In these terms of sale, "we" means Sofa & Home Limited (and "us" and "our" will be construed accordingly); and "you" means our customer or potential customer for products (and "your" will be construed accordingly).

(3) Order process

You can order and pay by any Major Credit or Debit Card either by phone, or by ordering and paying through our secure website checkout.

The advertising of products on our website constitutes an "invitation to treat"; and your order for products constitutes a contractual offer. No contract will come into force between you and us unless and until we accept your order in accordance with the procedure detailed below.

In order to enter into a contract to purchase products from us, you will need to take the following steps:

(a) you must add any of the products you wish to purchase to your shopping cart, and then proceed to the checkout.

(b) as a customer, you must select your preferred method of payment and confirm your payment. We will then send you the initial acknowledgement of order/ sales receipt (at which point your order will become a binding contract).

(c) we will either send you an email order with delivery confirmation details or we will confirm by telephone that we are unable to meet your order due to stock issues or a postcode delivery surcharge. In this case your purchase card will not be authorised unless you wish to continue with the order.  We store the contracts content and will send you the details of your orders as well as our delivery terms via email. You can find the terms here at all times. The details about your recent orders can be found in your customer login. We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale for your records. Please note that in some instances, your email service provider may deem emails as 'junk' 'trash' or 'spam' so please check in these folders if the email does not appear in your inbox.

(d) the only language in which we provide these terms of sale is English. The currency used on this website is GBP.

(e) before you place your order, you will have the opportunity of identifying whether you have made any input errors. You may correct those input errors before placing your order. If you have written a number in error and placed your order, please contact Sofa & Home to correct your details.

(f) delivery date windows start usually from receiving the Suppliers Acknowledgement.

(4) The products

All products are sold on the basis that they are suitable for domestic use only. We are not responsible for any financial loss or damage or personal injury sustained by the Customer in the use of our furniture. All dimensions are approximate, Sofa & Home cannot be held responsible for any product recommendations or warranties given. Using Image Enhancing Software we endeavour to realise colour accuracy, but due to the limitations of colour reproduction and individual colour settings of your PC, Laptop or Mobile Device, we cannot guarantee exact colour match as seen on Sofa & Home's website. Due to batch production methods used, we cannot guarantee a perfect match between pieces of furniture ordered at separate intervals.

(5) Price and payment

Prices for products are quoted on our website. The website contains a large number of products and it is always possible that some of the prices on the website may be incorrect. We will verify prices as part of our sale procedures so that a product's correct price will be stated when you pay for the product.

In addition to the price of the products, you may have to pay a delivery charge, which will be as stated when you pay for the product.

Payment must be made upon the submission of your order. We may withhold the products and/or cancel the contract between us if payment is not received from you in full in cleared funds.

The prices on the website include Value Added Tax where applicable. VAT Invoices are issued by request only.

Payment for all products must be made by credit or debit card OR any method detailed on the website from time to time.

Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.

(6) Your warranties

You warrant to us that:

(a) you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;

(b) the information provided in your order is accurate and complete;

(c) you will be able to accept delivery of the products;

(d) you are resident in England, Scotland, Wales and N. Ireland; and you are at least 18 years of age.

(7) Delivery policy

We will arrange for the products to be delivered to the address for delivery indicated in your order.

We will use reasonable endeavours to deliver products on or before the date for delivery set out in our order confirmation. However, we cannot guarantee delivery or collection by the relevant date, which may be due to supplier or carrier problems. Administration or delivery errors committed by couriers/carriers are beyond our control. We are not responsible for any loss or damage caused by third party carriers used in storage and/or the delivery of goods or any personal injury sustained by the Customer. Any incorrect address, due to an administration error by the supplier or carrier, will be the responsibility of the respected party.
Customers giving incorrect addresses, causing the carrier to return the item (s) to their warehouse and onwards to our supplier will be charged the return fee. If our DHD courier attempts delivery and delivery is failed due to inadequate space then you will be charged full price for delivery costs, plus any other returns costs. For those living in the Islands we can deliver to a UK Shipper of your choice on the mainland. We can assist with shipping information for you to organise and any VAT refunds where applicable. Please note responsibility is yours for any damage or loss in transit and we suggest taking out insurance for this.

(8) Risk and ownership

The products will be at your risk from the time the item(s) are delivered. Ownership of the products will only pass to you upon the later of:

(a) delivery of the products; and

(b) receipt by us of full payment of all sums due in respect of the products (including delivery charges).

We will be entitled to recover payment for the products even where ownership has not passed to you.

(9) "Cooling off" period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you may cancel a contract to purchase a product or products at any time within 14 days from the day you received the relevant product or products (subject to the limitations set out below). If you cancel a contract on this basis, you must inform us in writing or any other durable medium.

You will not have any such right insofar as a contract relates to the supply of goods made to your specifications or clearly personalised.

Products returned by you in accordance with this section will be refunded in full (including the cost of sending the products to you). However, you will be responsible for paying the cost of returning the product to us. Please see Returns (15) and Returns Procedure (16).

If you cancel a contract on this basis and you do not return to the products to us, we may recover the products and charge you for the costs we incur in doing so. Similarly, if you return the products at our expense, we may pass that expense on to you.

(10) Statutory rights

Nothing in these terms of sale affects your statutory rights (including your right to receive a refund in respect of any defective product we sell to you).

(11) Limitations of liability

Nothing in these terms of sale will limit or exclude your or our liability for: (i) death or personal injury caused by negligence or misuse of any items bought from this website; (ii) fraud or fraudulent misrepresentation; or (iii) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.

Subject to this, the products we sell are intended for personal use only and we will not be liable for any business losses (including without limitation loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time).

(12) General terms

Images of products on our website are for illustrative purposes; actual products may differ from such images.

Suppliers and Manufacturers reserve the right to alter prices and product specifications or withdraw models with or without notice.

We will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms and conditions.

Contracts under these terms of sale may only be varied by an instrument in writing signed by both you and us. We may revise these terms of sale from time to time, but such revisions will not affect the terms of any contracts which we have entered into with you.

If any provision of these terms of sale is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

No waiver of any provision of these terms of sale, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that provision or any other provision of these terms of sale.

You may not assign, charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of sale, at any time - providing such action does not serve to reduce the guarantees benefiting you under these terms of sale.

Each contract under these terms of sale is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.

Subject to the first paragraph of section [12]: these terms of sale contain the entire agreement and understanding of the parties in relation to the purchase of products from our website, and supersede all previous agreements and understandings between the parties in relation to the purchase of products from our website; and each party acknowledges that no representations not expressly contained in these terms of sale have been made by or on behalf of the other party in relation to the purchase of products from our website.

These terms of sale will be governed by and construed in accordance with English law, and the courts of England, Scotland and Wales will have jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.

Sofa & Home Limited reserve the right to alter and amend these Terms & Conditions at any time.

Our review site is operated by a bona fide independent company, Reviews.io. They only verify customers that have ordered items from us by order number. Any unauthorised comments will be removed and we do not recognise comments on any other review site.

(14) Cancellation & Returns

Before our delivery team leave, do please check you are happy with everything and sign the delivery note which confirms receipt of your order and that no damage has occurred to the order or your property. If there are any issues at all with your order, please make notes on the paperwork and the driver can feed it back to us straight away.

We reserve the right to cancel any Customer's order for whatever reason. We have zero tolerance on verbal abuse. Orders will be cancelled immediately.

If you wish to cancel your order, you must telephone and email notice of your intent to cancel. We do not reinstate orders that have been cancelled.

We understand that from time to time you may wish to return a product to us.

We have created this 14 day returns policy to enable you to return products to us in appropriate circumstances.

This returns policy applies to customers in the UK irrespective of your geographical location.

'This policy does not affect your statutory rights (such your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.'

(15) Returns

(a) a Collection Fee is applied to goods returned only by our approved couriers to our suppliers or to our warehouse;

(b) cancellation of an order whilst the item (s) are in transit for whatever reason, will incur a Collection Fee to return to the supplier;

(c) you comply with the returns procedure set out below; and

(d) none of the exclusions set out below apply;

(16) Returns procedure

In order to take advantage of your rights under this returns policy, you must telephone and email notice of your intent to return the products.

Damaged and faulty items must be reported within 72 hours. We require photographic evidence as we cannot process your return without these. If you refuse to accept a replacement of a damaged or faulty part and wish to return the whole goods, the Returns charges will apply. We will require you to take care of the item (s) after you have taken delivery of it until it is collected; please repack the item (s) carefully in their original packaging, as it might be necessary to return it to the manufacturer. Couriers will refuse to collect an item or items that are not packaged properly. We are not responsible for any financial loss or damage or personal injury sustained by the Customer while awaiting collection of a faulty or damaged item (s).

Please include your customer order details with the item (s) to be returned, as these are necessary for processing a return. Once received, the item (s) will be checked and must be in perfect re-saleable condition. Our customer service department will contact you to discuss a possible replacement or a refund, less any fees described above.

(17) Exclusions

The following kinds of product may not be returned under this policy:

(a) any product made to your specification;

(b) any product made to order;

(c) any Product that has been assembled;

(d) any Mattress that has been used or Mattress packaging that has been opened. (Health & Safety Reasons)

(18) Refunds

We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

We will process the refund due to you as soon as possible and, in any event, within 14 days from the day we received your returned product or your valid notice of cancellation.

Where part returns apply to promotional packages, we reserve the right to refund the amount in proportion to the promotion.

(19) Improper returns

Where you return a product in contravention of this policy (and where you do not have any other legal right to return the product):

(a) we will not refund or exchange the product;

(b) we may retain the returned product until you pay to us such additional amount as we may charge for re-delivery of the returned product; and

(c) if we do not receive payment of such additional amount within 14 days of issuing a  request for payment, we may destroy or otherwise dispose of the returned product being our sole discretion without any liability to you.
